What is Paternity?

Generally speaking, when a married couple has a child, the husband is considered the father. An unmarried couple that has a child can sign a Voluntary Declaration of Paternity before or after leaving the hospital to establish paternity.

However, there are cases where a Voluntary Declaration of Paternity has not been assigned, leaving legal parentage unestablished. In these situations, either parent can file a complaint or petition to establish a child’s paternity in court. Genetic testing may be needed for unmarried parents who cannot agree about paternity for their child or children.

Why Establish Paternity?

A child’s parentage must be legally established to attain child support, custody, or visitation orders. These items can be requested during a case that determines a child’s parentage.

The father must be established as the biological parent of the children in question before the following:

  • The children can be granted the right to receive financial support from the father.
  • The father is granted legal rights regarding the children, including visitation or participation in major decisions that involve the children.

Response To Establishing Paternity Package

Our Response to Establishing Paternity Package is for cases where an individual has been served with a Petition to Establish Parental Relationship. Your response indicates that you agree with the items in the Petition. This response is not applicable if the parents of the child are under 18, the child has not yet been born, or you disagree with the terms laid out in the Petition, and you want to contest them instead.

Our Response to Establishing Paternity Package includes the following forms:

  • Response to Petition to Establish Parental Relationship
  • Declaration Under Uniform Child Custody Jurisdiction Enforcement Act
  • Proof of Service by Mail
  • Income and Expense Declaration (may not always be required)

If you do not file a response, the Court is allowed to make orders regarding child custody, child support, and visitation based solely on the terms laid out in the Petition to Establish Parental Relationship.
